The Supreme Judicial Council on Monday deferred a case that was brought to the apex court seeking a declaration that asbestos was a threat to the life of the people of Bihar.
In its order, the apex bench of Chief Justice K S Thakur and Justice Dipak Misra said that the case, which was filed by the Bihar government, was not before it for a resolution.
The court’s order has been awaited by the government and the Bihar High Court, which had earlier issued notice to the HC on February 26.
Earlier, the HC had given notice to both the courts to hear the case and issued directions on March 5.
A senior lawyer of the Bihar Government in a brief statement on Monday said, “The HC has deferred the matter.
However, it will now take up the matter in the next week.
We will not accept the HC’s orders as they are not in conformity with the Constitution.”
Earlier in the day, the Bihar cabinet had cleared the Cabinet Resolution for the first time.
The cabinet has cleared the Resolution for setting up a National Institute of Materials and Science (NIMS) for the study of asbestos, it said.
The NIMS is set to have a chairperson and a chairman of the Board of Directors, it added.
